1. Acceptance of the Terms of Use

These Terms of Use are entered into by and between you and Benoit Enterprises, LLC, and its affiliates and subsidiaries (“we,” “our,” or “us”). The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, “Terms of Use”), govern your access to and use of our website(s) (the “Website”), including any content, functionality, and services offered on or through it (the “Services”).

Please read the Terms of Use carefully before you start to use the Services. BY USING THE SERVICES, YOU ACCEPT AND AGREE TO BE BOUND BY THESE TERMS OF USE AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE, DO NOT ACCESS OR USE THE SERVICES.

These Terms of Use contain an arbitration clause and class action/jury trial waiver. By agreeing, you waive your right to file a lawsuit in court.

The terms “you” and “your” refer to an individual registering with or accessing any or all of the Services. You represent that you have the full right, power, and authority to enter into and perform these Terms of Use without the consent of any third party.

We fully support the principles of the Fair Housing and the Equal Opportunity Act.

We may revise or update these Terms of Use at any time, at our discretion. Changes become effective immediately upon posting. Continued use of the Services after changes means you accept those changes.

3. Use of the Services

  1. Eligibility: You must be at least 18 years old to use the Services.
  2. Non-U.S. Users: Our Services are controlled from the U.S. and may not be appropriate for use elsewhere. By using the Services, you consent to data transfer to and storage in the U.S.
  3. Accounts: You may need to register for an account. You are responsible for safeguarding your login credentials.
  4. Prohibited Uses: You agree not to misuse the Services or engage in any unlawful or prohibited activity as outlined in the full version.
  5. Agent Users: If you are a licensed agent, you may access additional services under a separate Brokerage Agreement.
  6. Service Changes & Suspension: We may suspend or terminate any part of the Services at our sole discretion.
  7. Monitoring: We reserve the right to monitor usage to ensure compliance.
  8. Your Representations: You warrant that all your activity and content shared via the Services is accurate and lawful.
  9. Property Data Restrictions: All real estate data provided is for personal use only and may not be redistributed.
  10. User Content: You are solely responsible for your User Content and grant us a broad license to use it in connection with the Services.

4. Compliance Services

We do not provide legal compliance guidance. You are solely responsible for compliance with applicable laws.

5. Intellectual Property Rights

All content and functionality of the Services are owned by Benoit Enterprises, LLC or its licensors and are protected under intellectual property laws.

6. Licenses

We grant you a limited, non-transferable, non-exclusive license to use the Services for personal, non-commercial use. You grant us a broad license to use your submitted content.

7. Information and Data

Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to our collection and use of data as outlined.

8. Payment

If fees apply, you agree to pay according to provided statements or agreements. Late payments may incur interest.

9. No Warranties

The Services are provided “as is” without warranties of any kind.

10. Limitation of Liability

Our liability to you is limited to the greater of fees paid or one hundred dollars ($100). We are not liable for indirect, incidental, or consequential damages.

11. Indemnification

You agree to indemnify Benoit Enterprises, LLC, its affiliates, and representatives against claims arising from your use of the Services or violation of these Terms.

12. Third Parties

We may offer third-party services. These are governed by their own terms. We are not responsible for third-party content or services.

13. Arbitration, Waiver of Jury Trial, & Class Action Waiver

You agree to resolve any disputes through binding individual arbitration and waive your right to a jury trial or class action participation.

14. Equitable Relief

We may seek injunctive relief if you breach our rights or misuse confidential information.

15. DMCA Policy

If you believe your copyright has been violated, please follow the process outlined in our DMCA Copyright Policy.

16. Miscellaneous

  • Relationship: No joint venture, partnership, or employment relationship is formed.
  • Governing Law: These Terms are governed by Ohio law.
  • Waiver & Severability: Failure to enforce provisions does not waive them. Invalid provisions are severable.
  • Entire Agreement: These Terms and the Privacy Policy constitute the full agreement.
  • Headings: Headings are for convenience only.
  • Third-Party Rights: These Terms benefit Benoit Enterprises, LLC and its affiliates.
